The photo above is of Aileen Smith holding the lifeless body of her son. Aileen and her husband Zach were traveling along Interstate 25 in San Miguel County, N.M., when a car driven by Ramon Hernandez, 43, collided with their vehicle. Aileen Smith suffered severe contusions to her midsection as well as a broken sternum. She was seven months pregnant with the couple’s first child.
She was taken to Christus St. Vincent Regional Medical Center in Santa Fe where doctors performed a C-section in an attempt to save the baby. But the injuries to the unborn child were too severe and he died only minutes after being delivered. The baby died from a massive head injury and blood on the brain, according to a coroner’s report.
“There was nothing they could do,” Smith told The Albuquerque Journal. “I woke up from surgery and was reaching out asking for my son, and the nurse leaned over and told me that he had passed.
The Smiths named the boy after Aileen’s grandfather, Demetri.
They were on the way to a baby shower for Aileen when they were struck by Hernandez. The funeral was held only two days before Aileen’s 26th birthday.
According to the New Mexico authorites, Hernandez was convicted of DUI twice in 2000, once in 2003 and once again in 2004. He was also driving on a revoked license at the time of the crash due to multiple unpaid traffic tickets. He has pleaded not guilty.
Hernandez is currently being held on a $25,000 cash-only bond as well as an Immigration and Customs Enforcement detainer.
